Darkboard Prime — Licence Agreement

Version 1.0, 25 October 2026.

Darkboard Prime is free. It's licensed to you, not sold. By installing or using it you agree to these terms. If you don't agree, don't install or use it.

1. Who this is between

This agreement is between you and Ricardo Curtis ("I", "me"), who owns Darkboard Prime. "The Software" means Darkboard Prime: the program, its updates, its files and its documentation. It does not include the third-party libraries listed in section 6.

2. What you may do

  • Install and use the Software on any number of computers you own or control, at no cost.
  • Use it for any purpose, personal or commercial, including paid storyboard work for studios and clients.
  • Use it inside a studio or school, as long as each copy comes from the official site (section 4).

3. Your work is yours

Everything you draw, write, import or export with the Software belongs to you. I claim no rights in it.

4. What you may not do

Unless the law gives you a right that can't be taken away, or section 6 allows it, you may not:

  • Sell it. Do not sell, rent, lease, lend, sublicense or charge for the Software, or for access to it, in any form, including bundled with other products or services.
  • Re-host it. Do not upload, mirror or distribute the Software or its installer anywhere. The only official source is darkboardprime.com. Point people there.
  • Modify it. Do not modify, adapt, translate or make derivative works of the Software.
  • Take it apart. Do not decompile, disassemble or reverse-engineer the Software, or try to get its source code.
  • Change its marks. Do not remove or change any copyright notice, the licence screen, the name or the logo, and do not pass off a copy as your own or as an official version.
  • Use the name. Do not use "Darkboard Prime", or a confusingly similar name, for any product or service.

5. Ownership

I own the Software and all copyright and other rights in it, apart from the third-party parts in section 6. This agreement gives you a licence to use it. It does not transfer ownership. I keep every right not expressly given to you.

6. Third-party libraries (Qt and others)

The Software uses open-source libraries, including the Qt framework under the GNU Lesser General Public License version 3 (LGPL-3.0). Each library stays under its own licence, listed in "Third-Party Notices" (in the app under About, and on the site). Nothing in this agreement limits your rights under those licences. In particular, as the LGPL requires:

  • You may replace the Qt libraries bundled with the Software with your own compatible or modified versions.
  • You may modify the Software for your own use, and reverse-engineer it, only as far as needed to make and debug such a replacement. This exception is narrow. It does not allow you to distribute a modified Software, or to use it for anything else in section 4.

The Qt source code is available from https://download.qt.io and from me on request.

7. Updates and data

The Software works offline and sends no data anywhere. Updates are announced by email to people who signed up, and published on the official site. I'm not obliged to provide updates, support or a Windows version.

8. No warranty

The Software is provided "as is", without warranty of any kind, express or implied. That includes merchantability, fitness for a particular purpose and non-infringement. Keep backups of your work. You use the Software at your own risk.

9. Limit of liability

To the fullest extent the law allows, I am not liable for any indirect, incidental, special or consequential damages, or for lost data, work, profits or time, arising from the Software, even if told they were possible. My total liability for any claim is limited to CA$10. Some places don't allow these limits, so they may not fully apply to you.

10. Ending the licence

This licence lasts until it ends. It ends automatically if you break any term. When it ends, stop using the Software and delete every copy. Sections 3, 5, 8, 9 and 11 survive.

11. Law

This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction. The UN Convention on Contracts for the International Sale of Goods does not apply.

12. The whole agreement

This is the entire agreement about the Software. If a court finds any part unenforceable, the rest still applies. I may publish new versions of this agreement; a new version applies to versions of the Software released with it.
